Swali Kuhusu Uchaguzi
Swali:
ﺑﺴﻢ ﷲ ﺍﻟﺮﺣﻤﻦ ﺍﻟﺮﺣﻴﻢ
Kwa kupitia utafiti juu ya uharamu wa muislamu kushiriki katika mifumo ya utawala iliyopo hivi sasa ambayo haihukumu kwa Uislamu, amesema mtu mmoja kwamba yeye kamsikia mmoja wa masheikh akiruhusu kushiriki kwa kutumia dalili kwamba,
– Nabii Yusuf (a.s) alihukumu kwa sheria ya mfalme wa misri na kwamba pia mfalme Najashiy alikaa miaka mingi akihukumu kwa sheria za kikafiri pamoja kwamba alikuwa ni muislamu na Mtume (saw) alimswalia swalaatul ghaib pale alipokufa.
– Kisha kwa hoja ya kuangalia maslahi, kwa sababu muislamu akiwa ni mtawala atachunga maslahi ya waislamu kuliko mtawala kafiri?
Swali ni kwamba je kuna usahihi wowote wa dalili hizi?Je ni kweli kuna masheikh wanaosema maneno haya? Naomba kujibiwa, wa jazaakumu-ll-aahu khayra.
Jibu:
Ndio kuna baadhi ya masheikh wa kisultani wanaosema maneno haya, nayo ni maneno yasiokuwa na hoja, kwa sababu kutawala kwa yale alioyateremsha Allah na dalili zake ziko wazi, zimethibiti moja kwa moja na ushahidi wake ni wa moja kwa moja (qat’iyatu thubuti waddalalah) na wala hakuna tofauti baina ya maimamu kuwa hukumu ya yale alioteremsha Allah ni faradhi.
Anasema Allah:
(فَاحْكُمْ بَيْنَهُمْ بِمَا أَنزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ عَمَّا جَاءَكَ مِنْ الْحَقِّ)
‘basi wahukumu baina yao kwa yale alioteremsha Mwenyezi Mungu, wala usifuate matamanio yao kwa kuacha haki iliokufikia’ TMQ:5:48’
Na anasema Allah:
(وَأَنْ احْكُمْ بَيْنَهُمْ بِمَا أَنزَلَ اللَّهُ وَلاَ تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنزَلَ اللَّهُ إِلَيْكَ)
(Na wahukumu baina yao kwa yale alioyateremsha Mwenyezi Mungu,wala usifuate matamanio yao.nawe jihadhari nao wasijekukugeuza na baadhi ya yale aliokuteremshia Mwenyezi Mungu) TMQ 5:49
Dalili kuhusu maana ya aya hizo zipo nyingi mno:
Ama kutokuhukumu kwa sheria za Allah na kuelekea kuhukumiana kwa sheria za kutungwa na wanaadamu hakika hilo ni ukafiri pindi atakapoamini hivyo mtawala, na ni dhulma au ufasiki kama hakuamini hivyo mtawala,na haya yamepokelewa katika kauli ya allah :-
(وَمَنْ لَمْ يَحْكُمْ بِمَا أَنزَلَ اللَّهُ فَأُوْلَئِكَ هُمْ الْكَافِرُونَ)
(Na wasiohukumu kwa yale alioyateremsha Mwenyezi Mungu basi hao ndio Makafiri)
TMQ: 5:44
(وَمَنْ لَمْ يَحْكُمْ بِمَا أَنزَلَ اللَّهُ فَأُوْلَئِكَ هُمْ الظَّالِمُونَ)
(Na wasiohukumu kwa yale alioyateremsha Mwenyezi Mungu basi hao ndio Madhalimu)
TMQ: 5:45
(وَمَنْ لَمْ يَحْكُمْ بِمَا أَنزَلَ اللَّهُ فَأُوْلَئِكَ هُمْ الْفَاسِقُونَ)
(Na wasiohukumu kwa yale alioyateremsha Mwenyezi Mungu basi hao ndio Mafasiki)
TMQ: 5:47
Na ama yale waliotolea dalili masheikh wa masultani, kama tulivyosema hayana hoja, nayo ni kwa sababu zifautazo:
1-Hakika kutoka kwa kazi za Nabii Yusuf kwa wale wanaosema kwamba alikuwa anahukumu baadhi ya mambo kwa sheria za mfalme wa misri, yaani si kwa yale alioyateremsha Allah, dalili hii hapa si mahala pake, kwa sababu sisi tumeamrishwa kuufuata Uislam ambao kaja nao Nabii Muhammad (s.a.w) ambao kapewa Wahyi na Allah na wala hatukuamrishwa kufuata sheria aliokuja nayo Nabii Yusuf au nabii mwingine katika manabii wa Allah, nayo ni kwa sababu kwamba sheria ya waliokuwa kabla yetu sio sheria yetu, nayo imefutwa na Uislam.
(وَأَنْزَلْنَا إِلَيْكَ الْكِتَابَ بِالْحَقِّ مُصَدِّقًا لِمَا بَيْنَ يَدَيْهِ مِنَ الْكِتَابِ وَمُهَيْمِنًا عَلَيْهِ فَاحْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ عَمَّاجَاءَكَ مِنَ الْحَقِّ لِكُلٍّ جَعَلْنَا مِنْكُمْ شِرْعَةً وَمِنْهَاجًا)
(Na tumekuteremshia Kitabu kwa(ajili ya kubainisha) haki kinachosailisha vitabu vilivyokuwa kabla yake, na kuvihukumia (kama haya ndio yalioharibiwa au ndio yaliosalimika) basi wahukumu baina yao kwa yale alioyateremsha Mwenyezi Mungu wala usifuate matamanio yao kwa kuacha haki iliokufikia na kila ummah katika nyinyi (Binaadamu) tumeujaalia sheria yake na njia yake)
TMQ 5:48
Maana ya ‘muhaiminan- KUVIHUKUMIA’ yaani kinafuta, Uislam unafuta sheria za vitabu vilivyopita, kwa sababu hiyo ni kwamba sheria ya waliokuwa kabla yetu sio sheria yetu, nayo imefutwa na Uislam.
Pamoja na kwamba kuna baadhi ya wanazuoni wa Usuli wameichukuwa kanuni hii kwa namna nyingine pale waliposema ‘sheria ya waliokuwa kabla yetu ni sheria yetu muda wa kuwa haikufutwa.’ kanuni hii inaweka mpaka wa kuwa kutumia ushahidi wa sheria ya waliokuwa kabla yetu kutakubalika pale tu katika zile hukumu ambazo hazijafutwa na sheria yetu, ama zile hukumu za sheria ambazo zimekuja na sheria yetu na kufuta zile zilizopita haifai kuzichukuwa ,bali sisi tunatakiwa kutekeleza yale yaliokuja na sheria yetu.
Na kuhukumu kwa yale alioteremsha Allah jambo hili liko wazi katika Uislam na linafuta sheria zote zilizotangulia zilizokuwa kinyume nalo, na kwa mujibu wa haya ni kwamba hakika Maulamaa wa Usuli wenye kutegemewa, sawa wale wanaosema kanuni ya mwanzo ‘sheria ya kabla yetu sio sheria yetu’ au wale wanasema kanuni ya pili ‘kwamba sheria ya waliokuwa kabla yetu ni sheria yetu’ wote wanawajibisha kuhukumu kwa yale alioyateremsha Allah, kwa sababu yana dalili za wazi katika Uislam kwa uwazi wa kidalili na kuthibiti moja kwa moja na kunafuta sheria zilizotangulia zinakhalifu hili.
Na hata kama tutajaalia kuwa Yusuf (a.s) alihukumu katika baadhi ya mambo kwa sheria za Mfalme wa Misri, pamoja kwamba Usahihi ni kuwa Yusuf ni Nabii naye ni Ma’asumu (Kahifadhiwa na kufanya Makosa) basi hatahukumu isipokuwa kwa yale alioteremshiwa na Mwenyezi Mungu, kama alivyosema Mwenyezi Mungu katika surati Yusuf akijadiliana na Wenzie wawili Jela kwamba Hukmu ni ya Mwenyezi Mungu tu.
(يَا صَاحِبَيِ السِّجْنِ أَأَرْبَابٌ مُتَفَرِّقُونَ خَيْرٌ أَمِ اللَّهُ الْوَاحِدُ الْقَهَّارُ (39) مَا تَعْبُدُونَ مِنْ دُونِهِ إِلَّا أَسْمَاءً سَمَّيْتُمُوهَا أَنْتُمْ وَآبَاؤُكُمْ مَا أَنْزَلَ اللَّهُ بِهَا مِنْ سُلْطَانٍ إِنِ الْحُكْمُ إِلَّا لِلَّهِ أَمَرَ أَلَّا تَعْبُدُوا إِلَّا إِيَّاهُ ذَلِكَ الدِّينُ الْقَيِّمُ وَلَكِنَّ أَكْثَرَ النَّاسِ لَا يَعْلَمُونَ)،
(Enyi wafungwa wenzangu wawili! Je waungu wengi wanaofarikiana ndio bora (kuabudiwa) au Mwenyezi Mungu mmoja mwenye Nguvu (Juu ya kila kitu)? Hamuabudu badala yake (Mwenyezi Mungu) Isipokuwa Majina (Matupu) mlioyapanga nyinyi wenyewe na Baba Zenu (Mkayaita hayo Masanamu).Mwenyezi Mungu hakuteremsha dalili kwa hayo, Haikuwa Hukmu ila ni ya Mwenyezi Mungu tu; ameamrisha Msimuabudu yoyote isipokuwa yeye tu, hiyo ndio dini ilionyooka lakini watu wengi hawajui) TMQ 12: 39-40
Yusuf (a.s) anasema ‘Haikuwa Hukmu ila ni ya Mwenyezi Mungu tu’Utawala ni wa Mola wa walimwengu wote ambaye Muislam anamuabudu na anachukuwa Sheria zake toka kwake peke yake na wala hamfanyi Mola asiokuwa yeye Mwenyezi Mungu.
Nabii Yusuf haikuwa vitendo vyake vikitofautiana na maneno yake, unamuona analingania kuwa utawala ni wa Allah peke yake na hapo hapo ahukumu kwa Ukafiri!Hakika kauli hii ni kusema hivyo ni kumtusi na kumtukana Nabii Yusuf wakati kahifadhiwa na kufanya Makosa (Ma’asumu) na ni kumzushia Nabii wa Allah,na hili ni Jambo kubwa sana.
Kwa hiyo, kwa hakika Nabii Yusuf Hakuwa akihukumu kwa Ukafiri, Isipokuwa alikuwa anahukumu kwa Yale alioteremsha Mwenyezi Mungu, kwa Ukweli na Ikhlasi kwa ajili ya Allah.
Na kama tulivyosema hata kwa kujaalia kwamba Mwenyezi Mungu alimruhusu Nabii Yusuf katika Sheria zake ahukumu katika baadhi ya Mambo kwa kanuni za Mfalme wa Misri, kwa hakika Uislam Umefuta Sheria zote zilizotangulia, na umekuwa wajibu wetu baada ya kufikiwa na Ujumbe wa Mtume Muhammad (s.a.w) Ni kuhukumu kwa Uislam na wala si Vinginevyo.
2-Ama kutoa dalili kwa Tukio la mfalme Najashi hili pia si mahala pake, kwa sababu atakaeangalia kwa kina masuala haya atakuta kuwa Najash alikuwa ni MFALME Kabla ya kusilimu kwake, na alisilimu kwa siri na alikufa muda mchache baada ya kusilimu kwake, na wala hakuweza kuutekeleza UISLAM kivitendo na wala hakuwa na ujasiri kwa kutangaza kusilimu kwake, watu wake walikuwa ni MAKAFIRI… na hali hii haihusiani kwa yule ambaye ni muislam na anajulikana kuwa ni Muislam kwa watu, na tunaongezea jambo hili kwa uwazi, basi tunasema:
A-Hakika neno Najashi sio jina la Mtawala wa Habasha, isipokuwa ni lakabu ya kila Mtawala wa Habasha akiitwa “Najashi”kama vile akiitwa Mtawala wa Fursi “Kisra” na wa Rumi wakiitwa “Kaisar”….., na Najashi aliesilimu na Mtume (s.a.w) akamsawalia haikupita muda wake miaka miwili kama ilivyo katika swali lako, isipokuwa ni kitambo kidogo kisichozidi mwezi mmoja au miwili…sio Najash ambaye walihamia Waislam kwake wakitokea Makkah.Na wala sio Najash ambaye Mtume (s.a.w) alimtuma Omar bin Umayyah Dharmiy baada ya Sulhu ya Hudaibiyah wakati Mtume (s.a.w) alipotuma Barua kwa Wafalme na watawala, bali ni najashi Mwingine aliyetawala baada ya yule Najashi ambaye alitumiwa Barua na Mtume (s.a.w) pamoja na watawala wengine, na riwaya na mapokezi ya maudhui hii yako katika Bukhari na Muslim, na kwa hakika amekosea anaedhani kuwa Najashi huyo ndio Najashi ambaye walihamia kwake waislam toka Makkah au ni najashi ambaye alitumwa Omar bin Umayyah na barua ya Mtume (s.a.w) baada ya Hudaibiyyah na Mapokezo hayo yanapingana na yale yaliopo katika Bukhari na Muslim, kwa hiyo zinarudishwa.
Ama dalili ya hayo tulioyataja hapo nyuma, tunataja baadhi yake :
أخرج مسلم عَنْ قَتَادَةَ، عَنْ أَنَسٍ: («أَنَّ نَبِيَّ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى كِسْرَى، وَإِلَى قَيْصَرَ، وَإِلَى النَّجَاشِيِّ، وَإِلَى كُلِّ جَبَّارٍ يَدْعُوهُمْ إِلَى اللهِ تَعَالَى»، وَلَيْسَ بِالنَّجَاشِيِّ الَّذِي صَلَّى عَلَيْهِ النَّبِيُّ صلى الله عليه وسلم .) انتهى
Toka kwa Muslim toka kwa Qatada,toka kwa Anas :”Hakika Nabii wa Allah kaandika Barua kwa Kisra,na kwa Kaisar na kwa Najashi na kwa Kila Mtawala(Jabbar)aliwalingania kwa Allah(wawe Waislam)” na sio Najash ambaye alimswalia Mtume (s.a.w) baada ya kufa kwake
وأخرج الترمذي عَنْ قَتَادَةَ، عَنْ أَنَسٍ: («أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ قَبْلَ مَوْتِهِ إِلَى كِسْرَى وَإِلَى قَيْصَرَ وَإِلَى النَّجَاشِيِّ وَإِلَى كُلِّ جَبَّارٍ يَدْعُوهُمْ إِلَى اللَّهِ» وَلَيْسَ بِالنَّجَاشِيِّ الَّذِي صَلَّى عَلَيْهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. “هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ”) انتهى.
Na ametoa Tirmidh toka kwa Qatada, toka kwa Anas:
:”Hakika Nabii wa Allah kaandika Barua kabla ya kufa kwake kwa Kisra,na kwa Kaisar na kwa Najashi na kwa Kila Mtawala(Jabbar)aliwalingania kwa Allah(wawe Waislam)” na sio Najash ambaye alimswalia Mtume (s.a.w) baada ya kufa kwake)hii hadithi hasan sahihi.
Jambo liko wazi katika hadithi ya Muslim na Tirmidhi kwamba Najashi ambaye amesilimu na akaswaliwa na Mtume (s.a.w) sio yule Najashi aliyetumiwa Barua pamoja na watawala wengine.
B-Mtume (s.a.w)alituma Barua kwa watawala baada ya kurudi kwake toka Hudaibiyyah, yaani baada ya mwezi wa Mfumo pili (Dhulqaadah) mwaka wa sita Hijri,na kwamba huyu Najashi ambaye amesilimu sio yule aliyetumiwa barua pamoja na watawala wengine, bali ni Najashi wa Baada yake, itakuwa ametawala kiasi cha Mwaka wa Saba Hijri.
C- Na kwamba Abu Hurairah alikuwa pamoja na Mtume (s.a.w) wakati akimswalia Najash ambaye alisilimu kama ilivyo katika Hadithi za Kumswalia Najashi, na inajulikana kuwa Abu Hurairah alifika Madina pamoja na Ujumbe wa Dausi kiasi cha watu kati ya Sabini na Thamanini na akiwemo Abu Hurairah na Mtume (s.a.w) alikuwepo Khaibar nao wakamfuata huko na wakakutana naye huko na Mtume (s.a.w) aliwagawia ngawira za Khaybar.
Na vita vya Khaybar vilikuwa Mwaka wa Saba Hijri, na hii ina maana kuwa Najashi aliyesilimu alishika utawala wa Habasha mwaka wa saba na alikufa mwaka huo huo wa saba,na hakuishi isipokuwa siku chache au miezi michache tu…….
D-Wakati huo Wahabeshi walikuwa ni Makafiri wakifuata Dini ya Kinasara, na Mtawala wao Najash kasilimu pasi na wao Kujua, na pasi na Mtu yeyote kujua Mpaka Mtume (s.a.w) kama inavyofahamika katika Hadithi za Kumswalia Najash, Kajua Kifo cha Najashi kwa Njia ya Wahyi, na Mafhumu ya Hadithi yanaonyesha hivyo:-
– أخرج البخاري عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: «أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَعَى النَّجَاشِيَّ فِي اليَوْمِ الَّذِي مَاتَ فِيهِ خَرَجَ إِلَى المُصَلَّى، فَصَفَّ بِهِمْ وَكَبَّرَ أَرْبَعًا». وفي رواية أخرى «نَعَى لَنَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ النَّجَاشِيَّ صَاحِبَ الحَبَشَةِ، يَوْمَ الَّذِي مَاتَ فِيهِ»، فَقَالَ: «اسْتَغْفِرُوا لِأَخِيكُمْ».
– Ametoa Bukhari toka kwa Abu Hurairah”Hakika Mtume wa Allah (s.a.w) alitangaza Msiba wa Najashi siku hiyo hiyo aliofariki, akatoka kwenda katika Muswala akawapanga safu na akaswali kwa Takbira Nne” na katika Riwaya nyingine “Alitutangazia Mtume (s.a.w) kifo cha Najashi wa Habasha siku alipokufa” akasema “Mtakieni Msamaha Ndugu yenu “
– وأخرج البخاري عن جَابِرَ بْنَ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا، يَقُولُ: قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «قَدْ تُوُفِّيَ اليَوْمَ رَجُلٌ صَالِحٌ مِنَ الحَبَشِ، فَهَلُمَّ، فَصَلُّوا عَلَيْهِ»، قَالَ: فَصَفَفْنَا، فَصَلَّى النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَلَيْهِ وَنَحْنُ مَعَهُ صُفُوفٌ قَالَ أَبُو الزُّبَيْرِ: عَنْ جَابِرٍ «كُنْتُ فِي الصَّفِّ الثَّانِي»، وفي رواية أخرى عن جابر قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَ مَاتَ النَّجَاشِيُّ: «مَاتَ اليَوْمَ رَجُلٌ صَالِحٌ، فَقُومُوا فَصَلُّوا عَلَى أَخِيكُمْ أَصْحَمَةَ».
-Ametoa Bukhari toka kwa Jabir akisema: kasema Mtume (s.a.w)”Hakika amekufa leo Mtu Mwema wa Habasha, Njooni tumswalie” akasema: Tukapanga safu, Mtume (s.a.w) akamswalia na sisi tuko pamoja naye tukiwa kwenye safu, amesema Abu Zubaer toka kwa Jabir “Nilikuwa katika safu ya pili”na katika mapokezi mengine toka kwa Jabiri, amesema Mtume (s.a.w) pale alipokufa Najashi “amekufa leo Mtu mwema, simameni Mumswalie Ndugu yenu ” ASH’HAMAH”
Mafhumu ya maneno yaliopokelewa katika Hadithi:
(“Hakika Mtume wa Allah (s.a.w) alitangaza Msiba wa Najashi siku hiyo hiyo aliofariki”) (“Alitutangazia Mtume (s.a.w) kifo cha Najashi wa Habasha siku alipokufa” akasema “Mtakieni Msamaha Ndugu yenu” )”Hakika amekufa leo Mtu Mwema …..”)
ina maana kawa hawaku juwa kifo chake…
E-Na juu ya yote hayo kwa hakika hali ya Najashi hailingani hapa, alisilimu kwa siri na watu wake ni Makafiri, na alikufa baada ya muda mfupi wa kusilimu kwake, na hakuna aliyefahamu kusilimu kwake isipokuwa Mtume (s.a.w) kwa njia ya Wahyi. Hailingani hali hii juu ya kushiriki Muislam unajulikana Uislam wake katika Utawala unaohukumu kwa yale asioyateremsha Allah, na wanadai kufaa hilo hawana Dalili wala Shubha ya Dalili.
3- Ama dalili ya kuangalia Masilahi, kwa hakika ni dalili lakini pia ipo mahala sio pake, na tunaielezea kwa mfano ufuatao:
Wapo baina ya wanazuoni waliosema Kuangalia Masilahi kama Dalili, lakini wameweka sharti kuwa pasiwe pamepokelewa katika sharia amri au katazo ya jambo hilo, na ikiwa kuna amri au katazo ya jambo hilo basi haitafanya kazi “kuangalia maslahi”isipokuwa kitachukuliwa kile kilichokuja kwenye sharia, na wala hajapata kusema yeyote katika wanazuoni wa Usuli wenye kutegemewa kuwa Dalili za Kisheria zilikuja kwa wahyi zipuuzwe kwa hoja ya kuangalia Maslahi.
Riba ni Haramu imeharamishwa na Sheria kwa dalili zilizokuja kwa wahyi, Pindi Ikiwa Maslahi yanahitaji riba itumike, kwa hakika sharia inaipinga na inaiharamisha, pindi wakitoa Fat’wah baadhi ya wale wanaoitwa Wanazuoni kwa hakika Fat’wah zao zinarejeshwa kwao, na hizo zinapingana na sharia ambayo imekuja nayo wahyi.
Na suala la kuhukumu kwa yale asioyateremsha Mwenyezi Mungu ni haramu kwa namna ya moja kwa moja mfano uharamu wa Riba, kwa sababu dalili za wahyi zimekuja nazo, hakuna nafasi yoyote ya kuangalia Maslahi.Pale ambapo hakuna dalili ya kisheria ndipo inatumika dalili ya Maslahi na wala si kinyume chake.
Na sisi katika jambo hili tunawapitia wale wanazuoni wa Usuli ambao wamefanya wepesi na wakasema Kuna dalili ya Maslahi, na hata kwa msimamo wa hawa bado hakuna nafasi ya kuangalia Maslahi .na kwa hakika jambo la kuangalia Maslahi halipo, bali lipo kwa mtazamo wa wale ambao wanasema kuwa sharia imeacha baadhi ya Mambo pasi na kuyabainisha hukumu yake, wakati ukweli ni kwamba Sheria imebainisha hukumu ya kila kitu,
(…Ubainifu kwa kila kitu”TMQ 16:89), (Hatukuacha (Kuelezea) katika kitabu hiki kitu chochote,TMQ 6:38), (Leo nimeikamilisha kwenu nyinyi Dini yenu na Nimeitimiza Neema yangu kwenu nyinyi na nimeridhia Uislam uwe ndio Dini yenu.TMQ 5:3)
