Tuna matatizo na jinsi sheikh huyu alivyo chambua uhalisia wa sarafu za kidijitali na sehemu ya maoni chini ya makala hayo pia imesheni kina kaka wanao tofautiana na kujadiliana kuhusu jinsi uhakiki wa uhalisia wa mas’ala (Tahqeeq al-Manaat) ulivyo koseka kwa ukamilifu.
Tungependa kujua Hukmu kuambata na uuzaji na ununuzi wa sarafu za kijiditali.
Je, waweza kutupa mwangaza juu ya kadhia hii, kwani bado haijakuwa wazi kwetu.

Lakini niko na swali linalonikera kwa sababu ya yale ninayaona yanaenea hususan miongoni mwa Waislamu, katika miezi ya hivi karibuni.
Swali: Sarafu ya Bitcoin ilianza miaka 8 iliyopita na kwa sasa imeenea kwa kasi kiasi cha thamani ya sarafu moja kufikia zaidi ya dolari 8,000, na kupitia ufuatiliziaji wangu wa uhalisia wake na muamala wake, sikuona tofauti yoyote baina yake na dolari, isipokuwa dolari ina umbile la kimada lenye kushikika? Nataraji kuwa Sheikh wetu ataweza kuvua hukmu ya kisheria katika pande kadha wa kadha kama zifuatazo: 1. Kuamiliana nayo, katika ununuzi na uuzaji 2. Uundaji wake: “utengezaji sarafu mpya” 3. Ni ipi hukmu ya ubadilishanaji baina yake na sarafu zengine zenye kushikika? Ukitaka, naweza kukupa anwani ya tovuti na YouTube zenye kufafanua uhalisia wake, lakini nadhani ni rahisi kuzipata, Allah akubariki.

Wa Alaikum Assalam Wa Rahmatullah Wa Barakatuhu
Kuhusiana na maswali yako yote juu ya sarafu ya Bitcoin, siku za nyuma tuliwahi kujibu swali kama hili mnamo 28/4/2017, na hii hapa ni nasi ya jibu hilo:
1- Bitcoin si pesa; wala haitimizi masharti ya pesa kwa sababu pesa zilizo kubaliwa na kutabikishwa na Mtume (saw) zilikuwa za dhahabu na fedha, yaani, Dirham na Dinar. Pesa hizi za Kiislamu zilitimiza masharti matatu muhimu.
- Zilikuwa ndio msingi wa kutathmini bidhaa na huduma, yaani, zilikuwa ndio kipimo cha bei na ujira.
- Zilitolewa na mamlaka makuu yaliyo chukua jukumu la utoaji dirham na dinar na wala si taasisi isiyo julikana.
- Usambaaji wake ulikuwa umeenea na rahisi kupatikana miongoni mwa watu na hazikuwa maalumu kwa kipote cha watu fulani pekee.
Kwa kuyafanyiakazi haya juu ya sarafu ya Bitcoin, ni wazi kuwa haitimizi masharti hayo matatu ya juu:
- Sio msingi wa kutathmini bidhaa na huduma; ni chombo tu cha ubadilishanaji bidhaa na huduma maalumu.
- Hazitolewi na taasisi yenye kujulikana, bali haijulikani.
- Usambaaji wake haukuenea na sio rahisi kupatikana kwake miongoni mwa watu na zimefungika tu kwa wale wanao husika na ubadilishanaji na utambuzi wa thamani yake pekee, yaani, si za kila mtu katika jamii.
Hivyo basi, sarafu ya Bitcoin haitambuliwi kama pesa katika sheria ya Kiislamu.
2- Kwa hiyo, sarafu ya Bitcoin si chochote isipokuwa ni bidhaa; lakini, bidhaa hii hutolewa na chimbuko lisilo julikana; na haina udhamini. Zaidi ya hili, ndio kitovu kikubwa cha ulaghai, uhadaifu, shauku na udanganyifu, na hivyo basi, hairuhusiwi kufanya biashara kwayo, yaani, hairuhusiwi kuzinunua au kuziuza. Hususan kutokana na kutojulikana kwa chimbuko lake, hii inatia shaka kuwa chimbuko lake limefungamanishwa na nchi kuu za kirasilimali, hususan Amerika, au gengi linalo husishwa na nchi fulani kuu kwa lengo ovu, au kampuni kuu za kimataifa za kamari, ulanguzi wa mihadarati, ulanguzi wa pesa na upangiliaji na uendeshaji uhalifu. Iweje chimbuko lake liwe halijulikani?
Tamati ni kuwa sarafu ya Bitcoin ni bidhaa tu inayo tolewa na chimbuko lisilo julikana (majhool) isiyo kuwa na udhamini wa kihakika, na hivyo basi, kunaifanya kuwepo kwake kuwe na shauku na ulaghai, na ni fursa kwa nchi za kikoloni za kirasilimali, hususan Amerika, kupatiliza vitu kama hivi ili kufuja rasilimali za watu.

«نَهَى رَسُولُ اللهِ صلى الله عليه وسلم عَنْ بَيْعِ الْحَصَاةِ، وَعَنْ بَيْعِ الْغَرَرِ»
“Mtume wa Allah (saw) amekataza biashara ya Haswaah na biashara ya Gharar.”
Imepokewa pia na Tirmidhi kutoka kwa Abu Huraira…
Na maana ya biashara ya “Haswaah” ni wakati muuzaji wa nguo anapo mwambia mnunuzi: “Nitakuuzia kile ambacho kijiwe nitakacho kirusha kitaangukia” au “Nitakuuzia kile ambacho kijiwe kitacho rushwa na mkono wangu kitaangukia”. Kwa hivyo, hapa kile kinacho uzwa hakijulikani, na hii ni haramu.
“Muamala wa Gharar” ambayo haina uhakika; yaweza kufanyika au isifanyike, kama vile kuuza samaki akiwa bado yuko majini au maziwa ambayo bado hayaja kamwa, au kuuza kile ambacho bado hakija zaliwa na mnyama na kadhalika; ni haramu kwa sababu ni Gharar.
