Swali:
Ardhi ya Palestine imechukuliwa kwa dhulma na Mayahudi, na kuna majumba na ardhi nyingi ambazo zimechukuliwa kwa dhulma na wenyewe halisi hawajulikani. Baadhi ya umiliki wa ardhi hizi unapeanwa na umbile la Kiyahudi kwa watu binafsi au mashirika ili kuwekeza humo kwa miradi yao.
Naishi Palestine na nilipewa nafasi ya kukodisha duka la biashara katika jumba linalomilikiwa na Myahudi katika ardhi iliyochukuliwa kwa dhulma katika kijiji ndani ya Palestine na wenye ardhi hii hawajulikani (ima ni wakimbizi au wamefukuzwa).
Je inaruhusiwa kukodisha duka hili?
Ikiwa wenyewe halisi hawajulikani, hukmu itakuwa tofauti? Au inatizamwa kama ardhi iliyochukuliwa kwa dhulma, na hairuhusiwi kutumiwa katika kuiuza, kuinunua au kuikodisha?
Jibu:
Mali ilioibwa au kuchukuliwa kwa dhulma inabakia kuwa ni mali ya mmiliki halisi popote atakapoipata. Imesimuliwa na Ahmad kutoka kwa Samra kwamba Mtume (saw) alisema:
“Lau mtu aliibiwa mzigo wake, au aliupoteza na akaupata na mtu mwengine, basi yeye ana haki zaidi juu ya huo mzigo kuliko yule mtu mwengine, na aliyeununua lazima arudishiwe na aliyemuuzia kima alichonunulia.
Tirmidhi amesimulia kuwa Mtume (saw) alisema: “Mkono urudishe kilicho chukua”
Muslim amesimulia kutoka kwa Hadith ya Aisha (ra) kuwa Mtume (saw) alisema:
“Yeyote anaefanya dhulma juu ya shubiri moja ya ardhi, kila moja kati ya ardhi saba za dunia zitamzunguka (kumkaba shingo yake Siku ya Qiyama)
Hii inamaanisha kuwa yeyote aliyechukuwa ardhi yoyote kwa dhulma, kubwa au ndogo, anastahili adhabu itakayotegemea uamuzi wa hakimu (Qadi), na lazima arudishe alichochukua kwa mmiliki wake katika hali ilivyokuwa kabla kuchukuliwa kwa dhulma hii ni kutokana na alivyosema Mtume (saw): “Mkono urudishe kilicho chukua”
Ikiwa kitu kilichochukuliwa kwa dhulma kimeharibiwa na aliyekichukua au kimebadilishwa hali, basi ni lazima kwa aliyekichukuwa kulipa thamani yake.
